What Is a Notary Public? Everything You Need to Know

5 min read

A notary public is a state-commissioned official authorized to witness the signing of important documents, administer oaths, and certify copies of documents. Their primary role is to serve as an impartial witness — verifying the identity of signers and ensuring that documents are signed willingly, without coercion, and by the correct person.

Why Notarization Matters

Notarization adds a layer of legal authenticity to documents. When a notary witnesses a signature, they're certifying that:

  • The signer appeared before them in person (or via video for RON)
  • The signer's identity was verified using acceptable identification
  • The signer appeared to be acting of their own free will
  • The signer was of sound mind at the time of signing

This certification helps prevent fraud, protects all parties in a transaction, and gives documents legal standing in courts and official proceedings.

What Documents Need to Be Notarized?

Common documents requiring notarization include:

  • Real estate documents: Deeds, mortgages, refinancing packages
  • Powers of attorney: General, durable, healthcare, and limited POA
  • Estate planning documents: Wills, trusts, advance directives
  • Financial documents: Loan documents, financial affidavits
  • Legal documents: Affidavits, sworn statements, court filings
  • Vehicle title transfers: Sales and ownership transfers

What Does a Notary Actually Do?

At a notarization appointment, the notary will:

  1. Verify your identity using a government-issued photo ID
  2. Confirm you're signing willingly and understand the document
  3. Watch you sign the document (or acknowledge a prior signature)
  4. Complete the notarial certificate — the official stamp and signature that certifies the notarization
  5. Record the notarization in their official journal

Mobile Notary vs. Traditional Notary

A traditional notary requires you to come to their location — often a bank, UPS Store, or law office — during business hours. A mobile notary comes to you, wherever you are, at a time that works for your schedule.
